The Breeder Agrees:

The BUYER has 72 hours to have the puppy examined for any defects and notify the breeder of any faults found, otherwise the puppy is assumed to be healthy. If the puppy is determined to be anything other than healthy by the BUYER’S veterinarian, records must be submitted to Portland Pomskies and a dialogue between our veterinarian and the BUYER's veterinarian will occur. This animal is warranted against fatal genetic defects for 2 years from the date of purchase. Should this dog, covered under this puppy sale agreement, be determined to be suffering from a fatal hereditary defect (within 2 years from the date of purchase), Portland Pomskies will replace the dog with one of the same value when one is available, after notification and written verification has been furnished to the Breeder by TWO independent veterinarians. A picture of the dog must be sent to the Breeder every 6 months to uphold the health guarantee. X____________ (Initial)

Our dogs are free of diseases, disorders, and health problems; otherwise we would not breed them. This means our dogs are less likely to develop problems. If diseases, disorders, or health problems do occur, the Buyer shall inform the Breeder so the Breeder can evaluate the dogs and the other dogs from that litter to determine the cause of the ailment and to eliminate the issue from our breeding program. X ___________ (Initial)

Coccidia  

Giardia  

Weight  

Color  

Overbites  

Underbites  

Hernias  

Umbilical hernias  

Undescended testicles (Cryptorchidism)  

Eye color

The Breeder agrees to notify the Buyer if they or the vet discover any of the above problems prior to sale. By initialing, the Buyer agrees that they have read and understand what the Breeder does and does not guarantee.  X______________(Initial)

The Breeder states that the dog has received the following vaccinations, DA2PPv, at 7 weeks old. The Breeder shall provide the Buyer with a health record that contains valuable information about the health and care of your dog, including when a booster is due; your dog will need 2-3 more vaccines and rabies and then yearly boosters. The Breeder worms dogs with Strongid at 2, 4, and 6 weeks old and gives Drontal as the final wormer before leaving the facility. Please see your puppy’s health record for details on the health care your puppy has received while with the Breeder.

The Buyer Agrees:

That this dog will be given adequate and proper shelter and housed securely indoors. This dog shall not be neglected (some examples of neglect include failure to provide food, shelter, or veterinary care), allowed to roam free, or be mistreated in any manner. The dog shall receive proper veterinary care throughout its life, receiving annual inoculations and placed on a heartworm preventative. The dog shall receive proper nutrition and care shall be taken to maintain its proper weight. The Buyer agrees to give the dog proper training and socialization. The Buyer agrees to never sell or surrender this dog into a dog fighting institution, testing center, or shelter.

The Buyer agrees to spay/neuter the puppy at or around 6-8 months of age, and no later than 12 months. Once the dog is spayed/neutered, proof of surgery is to be supplied to Portland Pomskies. Failure to provide verifiable proof of the procedure will result in a breach of contract fine of $5,000.00, which will be processed and required to be paid in full within 30 days of the dog’s 1-year birth date. The Buyer agrees to finish all puppy vaccines before taking their dog out in public, letting their puppy on public sidewalks and grasses, or allowing their puppy to be touched by people outside of the family. This reduces the chance of your puppy picking up a communicable disease such as Parvo, WHICH CAN BE FATAL. X___________(Initial)

The Buyer agrees and is aware that Portland Pomskies retains all rights to the puppy prior to pick up and while the puppy is in their care and possession. If Portland Pomskies has any doubt about the puppy's well-being, fit for family, or quality of life for any reason, we retain the right to return the deposit and void the contract. The buyer is aware that failure to pick the puppy up between the designated pick-up dates could result in a $35.00 per day boarding fee. X____________(Initial)

The Buyer agrees to return the dog to the Breeder if, for any reason, the Buyer no longer wants to or is unable to keep the dog. The Breeder agrees to either assist the Buyer in finding another suitable home where the dog will receive proper care or to accept the dog back at any time with no refund. The Buyer will notify the Breeder of any changes of address and is encouraged to maintain contact with the Breeder throughout the life of the dog.   (Initial)

The Buyer agrees that if they do not want the puppy at any time after taking possession of the puppy, they will return to Portland Pomskies and understand that they will receive no refund for the return.

This document constitutes the entire agreement between Portland Pomskies and the Buyer concerning this dog adoption contract. The Buyer’s signature below indicates that he/she has read, agrees, and understands all conditions of the Sales Agreement and Contract of Sale. ALL SALES ARE FINAL.

The effective date of this Contract shall be the date below.
